New Building Warrany - 1 yr Old T/House

Hi All,

Heres my Dilema: Friends have bought a new townhouse in November 2018 it was signed off in August 2018 by the builder/Developer. Who also specialises in building for New Migrants - As per their webpage ! English is not their mother tongue so im assisting them being in the building industry, I have an idea about how & why.

First problem:

Upstairs free standing Bathtub cant drain fast enough & water flows from underneath the bath over the floor tiles. Asuming there is some sort of blockage, in correct plumbing fall that is slowing the flow of water, the floor trap backs up & it them makes its way out onto the carpet.

Second Problem:

The Dining Room Ceiling is leaking during strong winds, & it looks like this has happened previously as there is a square inspection hole that has come to light now that its wet, they still couldnt fix the problem ! Above this wet patch is the First floor wall & floor junction, a flat roof flashing that has not been cut/notched into the Hebel, Just Siliconed over render ! Not As Per Manufacturers Specification ! To top it off, the silicone has come away from the render & the flashing is pulling 5mm away from the wall, effectively catching the water !

Third Problem:

Renda Panel boundary Fence is cracking & render is blistering.


If they can get a fence right how can they get house right !


The Builder was contacted & problems explained, his response was short, sharp & shiney, The Builders 3 month maintenance warranty is over, thats your problem now !

Sorry theres nothing I can do ! & hung up.


The so called Builder is a member of Both major Nation wide Building Associations, I contacted both, & got bounced around to different departments, as no one really knew how to deal with the situation & in one instance ended up speaking to a lawyer, who were very deflective with their answers, the second time told that possibly through builders indemnity insurance there may be a claim, they came back a few days later: unless the builder has gone broke I would need to seek legal advice.

So apparently if its not structural, the builder walks & so do the Associations with their memberships that dont mean a cracker !

I was previously a member & did multiple courses as I am about to apply for my Builders & Supervisors Licence. Standards are No Longer ! How these Cowboys get a Licence is beyond me !


A 1 year old $600k Townhouse, lived in for 8 month that leaks & nothing can be done except get a lawyer ! Utterly Frustrated, Disapointed . . . .


At least you would think that the builder would come out to inspect & show some concern over his product. No he doesnt need to !


Can anyone offer me any other avenues ??
