Legal Advice About Neighbour.

Hi everybody,


I was wondering if anybody knew of any laws in regards to our neighbour killing and damaging our property.


About two or three years ago, our rosemary hedge started to die. It was fully on our side. He has spoken to us and constantly told us he wanted a metal fence all the way down to the road. And low and behold, our rosemary hedge started to die dramatically, to the point that within six months, it was nothing but grey sticks that looked like a fire had burnt through them. It was embarrassing to look at it. Awkward thing is though, the rosemary hedge on the either side was a rich and healthy green, and still is.

The hedge being killed resulted in us needing to remove it. A house two doors up (next door to him), also had their hedge magically die.

He had since installed, ugly, silver, metal fencing all the way down, and makes our house look cheap and nasty.


About a year ago, we noticed some trees in our backyard near the dividing fence between us and him where thinning out, and were going brown, but the other trees of the same breed (Lilly Pilly trees) were thriving and still are. We haven't removed the trees, but we did catch him once watering something into the ground with a hose.


About four weeks ago, we had a storm with strong winds, but our fence survived. Then the next day we heard a massive bang, and magically our fence was down. And from them on, he told us he wantede the whole fence replaced with the other fence behind his house that also magically came down. Since we refused to that, our fence has been pushed further down every week. We even caught him as he was doing it, as we picked up on his pattern (he'd give it a push as he puts his bins out). I've started keeping a photo record of each day, as every time we fix it (as our backyard is not at risk of being entered by anybody), he pushes it down more.


My question is - is there any laws, rules etc. that can help us? We live in Western Australia.


The man is a total control freak who has threatened people before and was always having trouble previously, had his house broken into, windows were constantly being smashed because people would drive past and throw rocks and bricks through it, and we've had enough!


And if anybody is wondering, no; we unfortunately cannot move away from him, as we aren't in a financial position to even dream about it. We struggle to pay the bills most weeks, little alone move. And it certainly doesn't help when you now have to pay half for a dividing fence you didn't even damage...
