What does the north side of the block face?

On which sides are the retaining walls?

What are the retaining walls made of, and who is responsible for them? It sounds as if one side is council parkland, is the retaining wall their responsibility? Is the other side another block of land, and is the wall on your side or their's? It would be useful to get a more precise idea than "more than 2 to 3 mtrs"?

Retaining walls are a real minefield and you need to ask your property solicitor for correct advice. Are the walls on the boundary (and become your problem in the future)? Will you need you own retaining walls (and there are minimum set backs between walls which will eat into your property)? Has drainage been property done when the walls were constructed? Were the walls properly engineered (height, footings, drainage)? Will the neighbouring properties overlook your living spaces (will you need to change your plans to avoid overlooking)?

Its about hammond park western Australia. The land has west front and the retaining wall is on west. The land is having slop downwards to east and south. The retaining wall is at east side as well as north. In attached pic you can see the retaining wall of east side. When asked to developer he said Id any damage the you and shire will share the responsibility.

Buy another block. Anybody playing in the park is going to be able to walk up to the fence and look down into your entire property. Also don’t take advice from the developer, they have a vested interest.

Sorry I think I misunderstood the drawings. Is your block on the high part of the retaining wall? That won’t be so bad for privacy. But it will impact your building envelope.

Which side are you looking at buying ? if its the upper section , there could be liability issues , but you get a great view of the park .

If its the lower part though , I personally would run as fast as I could -- you can't plant anything to add life and distract the eyes ; you'll lose the sun ; it looks ugly ; there's at least as many liability issues ; you'd be mad IMO .

Thats the front view and garden is just at back with 3 mtr high retaining wall

I would check with the Council and get confirmation that they do indeed go halves if there are any problems. The back wall is quite high for a retaining wall and may need maintenance over the years. My father shares a side fence with a park and the Council didn’t and doesn’t contribute at all to the fence. I would also expect that there may be additional construction costs when building on such a site.

Ok.... Actually when I asked about any planning approval or Building approval from developer then he replied it is approved as you see.... However, I asked them about product warranty from installer or vendor for retaining wall then he replied there is no any warranty in contract with buyers but we do have contract with installer and we dont share with buyers...

Secondly, old gmap image shows that current high is not natural form of land its pilled up

So what the Developer is telling you is that in two years if the wall cracks (and remember there will heavy machinery in your site and some will do heavy compacting) you are on your own. Your building warranty doesn’t cover retaining walls. What will you do then?

You can definitely see it’s not the natural lay of the land. As such you become responsible for the walls and any trouble caused by them (storm water flowing into neighbours, bits falling off the wall), as you’ve changed the lay of the land.

I misunderstood too, I thought you were below the retaining walls in which case what windows look out at the walls and where and and how much shade the retaining walls create are concerns. But if you are above the retaining walls they won't be shading the house. As mentioned, being raised up is good for views, and not being built out by neighbours. But as it faces west it's not where you want large windows anyway.

So it sounds like there is fill on the block? Not natural ground level but additional soil filled up. You should not be having to guess from old google maps. The developer needs to give you a map showing the details of fill on the block. That's the sort of thing that can add to construction costs, like if you need piers.

So not only is it about the structural reliability of the retaining walls, but about the ground the house will be built on.

I had another thought, shouldn't the developer tell you the classification of the block?

Your question about resale is an unknown, as you have not even built a home on the block. Many people enjoy having a park near by. And many people will enjoy being high up and looking down the 2-3 metres below to the park.

Hammond park was all market gardens, and a wet swampy area. With the many sub divisions in that area, the developers are bringing in tonnes of sand and altering the natural land. If you are happy with the blocks position with the massive retainer wall supporting your land, and the orientation of the block, then I would get an independent structural engineer to inspect the wall and the developers information, to ensure that the wall and the infill has been built to correct regulations.

Referring to your orientation description of the block, and the photo posted, it doesn't make sense.

Is the back of your block (the side with the 2-3m drop) at the west.

Or is the back of your block at the east.

If you have a park at the rear of the block, and the fencing you can see through, then ideally all your entertaining/lving areas would be good to have them enjoying that view. But, if this is facing west, then you will be competing with the hot summer sun in the afternoons. So you need to look at how you would protect the west side of the home in summer.

Also Hammond Park is not that far from the ocean, so you would want doors or windows that open up to the west, so the afternoon sea breeze can get through the home and cool it down in summer, without having to use your air-conditioning.

The back of the land is at the east... It has park at rear (east)

My reading is that the back of the block is the high wall in the pic. That is the east boundary. The front of the block is west. All three sides have a retaining walls. It’s a very difficult block, both for engineering and for orientation.

Thank you Guys for your guidance... Consedring all these things and its a corner lot as well hence I have cancelled my plan to go further on this land... Will find another one 😊
