Tiling placed wrong

Hi everyone, I'm renovating my apartment and the tiles have just gone down... unfortunately the tiler did not read his brief and has staggered my white subway tiles, not stacked. I wanted stacked to create a clean, modern line to offset the busy-ness of the hexagon. They are saying once the white grout goes in I won't even notice but I'm not so sure but getting them to rip it off, rewaterproof and retile seems dramatic, and not sure what my rights are. In my mind they should rip it off and do it again for free if I want it the way it was instructed?

The other issue is the wall is not plum(straight) and bowed (1970s building) so they are also saying that the tile I chose won't work and the staggered pattern allows them to compensate for that. So potentially if I demand they start again I will have to choose another tile?

Any advice or thoughts appreciated, I'm reaching decision fatigue/overload with this Reno! I haven't paid them anything yet. Thanks so much
